For anybody with 2009 Atlanta Braves equipment, or from any opposing team at Turner Field in 2009, I'd just like to let you all know that I'm doing photography at every series at Turner Field in 2009. If you have anything that you're trying to photomatch, and you need a specific picture from a specific game, then just let me know! I take typically 200-300 pictures every game I go to. I also try to get pictures of any equipment laying on the ground...so if I see something like a players bat bag, or the coaches Fungo bats, or anything like that, I get pics of that also. And another thing....I try to get pics of every player on the opposing team during batting practice, since sometimes getting style-matches for B.P. jerseys is hard to find. I sell prints too if anybody would like a copy if I have a pic that you need. I'll have a page set up on my site soon with all photos available from 2009. Here's a few examples from the Braves home opener last night:

wow there birthday boy,you really take some great pictures.Do you have a press pass or do you take these from your seats?..i also love taking pictures at the games i go to,so i can appreciate good photography,and yours is really good.I am very impressed with these.I used to be a braves fan back in 90's as i was a huge deion fan,those teams were great with the dream team pitching staff they had-glavine,maddox,smoltz and avery.I used to tape every game,cause we got tbs here.Even after deion left,i was a fan of thiers,I LOVED JOHN ROCKER!!!..That's right i said it.And that's saying alot being a lifetime yankees fan,as my dad handed that down to me and my one brother,which we now are carring on for him now.But anyway,just wanted to say,great pictures.:)

Thank you very much, I appreciate your kind words. I actually take all my pics from the stands. I get dollar-seats before the game and just do my best to sneak down for the best shots. But usually now I'll take pictures from the walkway where the wheelchair sections are, since the ushers usually don't mind if I take pictures from there. Oh, and don't worry, cuz I actually LOVED John Rocker, and I'm from New York myself :D

I've been getting a few e-mails lately from collectors asking if I have pictures from specifc games to help photomatch different pieces. So here is an update with games I have taken pictures at. Recently I have been taking around 600 or so pictures a game and I try to not miss anyone from both teams. Here's some example shots too from the past few games I attended:


Braves/Blue Jays 5/24/09

Braves/Astros 5/3/09 (pictures from this game are limited due to me having to leave early)

Braves/Cardinals 4/30/09 (pictures from this game are limited due to the fact that I was using a new lens which didn't work out as well as I planned...I ended up returning it after the game and bought another one)

Braves/Nationals 5/10/09 (Home Opener for the Braves...Opening Day for the Nats)

Braves/Tigers 4/3/09 (pictures from this game didn't come out as good as my most recent pictures since it was my first time using my new camera & lens and I had to learn how to work it)

Thanks.....it's actually my most favorite picture that I've taken so far this season. It only takes about 20 minutes to do that to a picture so I might do it more often with more of my pictures.

I use a Nikon D80. It cost me about $1000 (came with a 135mm lens). The lens I've been using for the past 2 games and which I will be using for the rest of the season is a 70-300mm lens. I'm able to just stand in the walkway at Turner Field (which is pretty far back) and I'll still get good close-ups. I'll at times take shots from the first section at the dugout as well. I edited that Yunel Escobar picture in GIMP, which is basically the free version of Photoshop. It takes only about 20 minutes to complete.

Cool pictures, I do photography as well at minor league games and stuff. I'll have to upload some tomorrow and post them on here, I actually have photomatches for almost every single bat I have gotten at minor league games. I use a Nikon CoolPix P80 which has a great 18x Optical Zoom.

I also offer full-resolution photos sent via e-mail for $3 (that's if you want to get it printed yourself). These photos look really nice when signed. I can show what a few of my photos look like signed if anybody is looking to see that.

Kyle ~ Wow! You are talented photographer! Some people think all you need is a good camera and lens but you also have to have a great sense of timing, a good eye, and knowledge of the game so you can anticipate a great shot that might be coming up. That's the difference between people who just take pictures and a craftsman.

A word of caution: MLB owns the rights to all images taken of MLB players. I know you are doing it because tit is great fun and to help out collectors ... and it is a perfect match for your photomatching skills. You might want to check it out because sometimes they crack down on photos sold without the MLB holo like Photofile images have.

I know what you mean. I haven't had any problems though. A lot of the ushers at Turner Field know about me and they never say anything (except for a few who try to tell me my lens is too long to be allowed in Turner Field). Normally I've been selling my photography to autograph hounds in the area. There's one lady who I deal with who I give free photos to, and in return she gets me the best seats in the house to take pics (usually the first section above the dugout from my DOLLAR ticket). She also gives my pictures to players so a lot of players on the team like Schafer, Campillo, Infante, etc. all have my photos. When it comes to photomatches, my photography also comes in handy a lot. I helped a forum member last year photomatch a Kelly Johnson helmet from chipped paint that I caught from my photos, and a few months ago I photomatched a Matt Kemp bat I saw on eBay from one of my photos. With the prices Getty charges for a tiny photo ($49 to be precise), I thought having my photos for $5 for an 8x10 is great for display and photomatch purposes.

They own the rights to TV broadcasts since they're considered to have enough originality that they can be copyrighted. But if you went to a game and took photos or even filmed the game, then MLB can't stop you from selling them; in fact, you can copyright them yourself to keep MLB from claiming ownership.

But this is why the teams can sometimes be so obsessive about keeping people from taking photos or especially video--because once you take the photos/video, MLB can't make any money off of it.

I've definitely heard about not taking video in Turner Field, but I'm always on/off about the photography. I know photography is allowed in Turner Field, but you can't have a lens extending past 5 inches. Mine is 7 inches but most ushers don't care.




Also.....I made a panoramic photo of Turner Field back when the Astros were in town. If anybody wants it as a desktop background or to print out, then be my guest to use it!:

Not true on pretty much all you mention here. You can't individually copyright a photo because they own it, even if you took the photo. The own all rights to each players' image.

Does anyone have a current baseball ticket handy to post? It used to say this on the back of every ticket.

From the back of an Indians ticket, I would think all have the same disclaimer:

"The holder is admitted to Progressive Field on the condition that the ticketholder will not transmit or aid in transmitting any description, account, picture, viedo, audio, reproduction, or other information concerning the game and game events to which this ticket admits".

OK, to prevent confusion, I'll just settle this. If you read this case (http://www.ca8.uscourts.gov/opndir/07/10/063357P.pdf), you'll see that MLB specifically does NOT own the rights to player likenesses, statistics, or names. The 8th circ. Court of Appeals held that "CBC's first amendment rights in offering its fantasy baseball products supersede the players' rights of publicity." Those fantasy baseball products included "names, nicknames, likenesses, signatures, pictures, playing records, and/or biographical data of each player."

Teams, CAN, however, prevent you from bringing cameras onto their property, which is what most of them do. That's how they keep people from taking video/nice photos, over which MLB could never claim ownership. Additionally, individual photographs CAN be copyrighted by the photographer (see, for a clear discussion: http://www.peterkrogh.com/copyright/main.html).

MLB can claim they own your photographs all they want; the back of a ticket is not dispositive over a federal court case. END OF STORY.

You can make the argument that the CA case only applies to fantasy baseball, but considering photos/video are so enmeshed with first amendment stuff, the holding would probably apply to just every-day people taking photographs for any kind of publishment or display...

I went to a Bob Dylan concert years back and took a picture real quick at my seat and put the camera in my pocket. A security guard came and asked me for my camera and told me I could get it back at the end of the show. Never seen or heard of anything like that before. Its ok, the show blew anyways.

I'm sorry kyle as i know we have gone off topic here,as you're just looking to see if anyone wants you're great pictures.But yeah NDEVLIN-It says it on almost all concert tickets.And it's for the reason,they don't want you selling them.But some acts still let you take pictures and years ago motley crue did a tour where they encourged fans to bring video cameras and they let you take videos and tape the show as they wanted people to trade them.And i know the grateful(i know spelled wrong,im not a dead head)dead are big on taping thier concerts.That's why i am suprised that happen at a bob dylan concerts,as i would think he would be one that would be ok with people doing that.All i know you're lucky,that you got your camera.Years ago i took a picture at a kiss concert and thier security came up to me and told me to give them the camera.And i said i would just give them the film,and they told me,"give us the camera and you can stay,or we can take the camera and you leave.your choice.But either way we get the camera".They refused to take just the film,and the more i argured the more security they were calling on thier walkie talkies as more security kept showing up.And when there was like 10 guys standing around me,i decided it was time to buy a new camera anyway.:)

MLB isn't going to bother families with Instamatics and flash cubes. And I believe they allow a personal one-time fair use. They do care about someone with a Canon professional series lens in the crowd. (That's not the lens Kyle has, that's an example.) They will check when they see offerings of photos for sale on the internet or at shows or in stores.

Concert tickets have the same copyright statements as MLB on the tickets. They just enforce it at the concert. They own the use rights to all images, so does MLB.

Actually, concerts though stricter on site, will generally allow a few sales of photos. Within a couple weeks of the show they are more lenient but not for long-term sales.

MLB is only going to get stricter as the more affordable, fantastic hi-res digital cameras appear in the crowd. Great amateur photographers like Kyle and some of the rest of us have to appreciate working on our passion and hobby while we can.

As an editor that worked with copyright law and rights, I was just giving Kyle a heads up about keeping low key if he chose to sell.

Yeah, I knew you were supposed to take pics, that why I did it quickly. I just didnt realize they were so strict about and actually ask for your camera. And I went to a Kiss concert as well back in 96 or so and it was a great concert. They put on a show.

Remember we're talking about high quality photos that amatuer photographers as talented as Kyle take. He's topping a lot of pros that I know!

The issue is sales and rights.

Even back in the dinosaur days of film (not digital) an amatuer like me could take a concert photo like this:

By knowing the laws and obeying them, I acquired permission to sell 5 copies of this photo. And with the money I bought a camera system the price of a car back then.

Joba, you'd maybe not be trying to take photos at a concert like this ... but this is what the Kiss security guards were concerned about that people can do who might not know and follow the copyright law. Interesting, you lost a camera and I bought a new one ... just by knowing the law and following it.

I'm sorry kyle once again for stepping all over your thread.But cordover said something i just have to respond to.I gave up my camera,because i did'nt feel like getting my butt kicked by 10 security personel,and besides that i did'nt want to miss the concert.Me giving up my camera had nothing to do with "me knowing the law and following it".It was about being able to look the same way after the concert as i looked before the concert.Because the security was'nt going to just let me walk out of the concert(if i made them take the camera from me,and i did'nt willing give it to them)from thier tone i took it as they were going to walk me.So that's why i gave it to them.I'm pretty sure me saying "hey that's not the law,i'm going to ask permission from kiss to sell it,so they will be alright with it"was going to make the security go,"well ok take your pictures then".It was'nt a fight i was going to win,even if i was right and the law was on my side,at that time they are the judge,jury,and if i did'nt give it to them,the exacutioner.They don't care if you ask permission to sell it,they don't care if it's just for you,no cameras means just that,cause they know once you take a picture,they can do nothing about it.Again like bands and sports once you take a picture,you are free to do with it what you may,it does'nt go by how good a picture it is.That's just funny,it's your picture,you took it,how can they own something you took with your own camera.But i don't watch perry mason so i can't say things on here as fact.:)

I totally agree with you chakes-That's why i apologized as i was guilty of it.But i just had to say something as this perry mason stuff drove me nuts.And it just sounded so funny to warn kyle about this.I take pictures just like kyle(just not as good) and i am pretty sure i don't have to worry about bud selig knocking at my door asking for the pictures.It's tough to read and be silent about things so you have no choince but take the bait and go off topic and for this i'm sorry kyle.That's it for me,back on topic,great pictures,kyle-are you going to be at the upcoming series vs the yankees?:)

Sorry, one more post. Treant, you missed the whole point in your own references. Here's the main quote from your second one:

That means they had to use fake names and fake likenesses UNTIL they bought/paid $$$ each league's players association for the use of the image rights.

And your first reference says nothing about an image of a specific player, singer, actor, celebrity, etc. That article is talking about if you take a picture of a tree, landscape, deer, etc. you can copyright it if you want to at the LOC. (But you really don't have to because the second you take it, you own it, you created it, you have the proof you took it. So it is usuallya waste of effort to go through the motions.)

But that applies only to images of generic things. You have to know your stuff when you start to sell because even some buildings own the copyrights to images of them. You can take a picture, make a poster, and sell it of an abandoned saloon in UnknownGhostown, USA ... but try and sell a poster you make of the Chrysler Building in New York ... OY!!!

Joba, don't explode. You get the permission to take the photos before the concert. And days later you get written permission to sell a specific photo a certain number of times. If they say no, the camera stays in car.

Kyle, you are GOOD! Makes me want to collect a player from Atlanta so I can have photomatches from you. Instead, I might just have to start collecting photos taken and signed by you!


Thanks....but actually you don't have to collect just Braves to have a need for my photos. I always take photos of the opposing side and I like getting close-ups of the bats and other equipment. Just yesterday at the Braves-Brewers, I was able to sit on the side of the opposing dugout so I got as many shots as I could of players warming up with their bats so I can get nice close-ups.

...so if anybody is getting any Brewers bats soon from these players....just let me know and one of these might be a good photomatch for you:

Yes...I'm going to try my best to make it to the whole series as well as the whole series against Boston which comes the day after the Yankees leave. The stadium is expected to be packed though so I'm hoping I can still find a good seat to take pics from.

The Braves just finished off in my opinion the best homestand ever at Turner Field, with the Cubs, Yankees, Red Sox, & Phillies all coming to town. I attended every series and all opposing photos are now posted up on my site:

Hey there great one-I was waiting for you to post your yankee pictures on here.So thank you for doing that.Needless to say-WOW!!!!Man you make me so jealous.I only wish i could take pictures as great as you.I am looking forward as the yankees are coming to town this coming week.And of course i will be taking pictures but i know they won't be as good as yours.It helps that you have a actual stadium and the stadium here (the inflatiable toliet) where around home you sit 80 feet above the field.Where you can get almost field level if you wanted,it's impossible to do that here.Like i said,we had first row at the yankees on-deck circle last season and i got some great shots of the top of jeter's helmet.Where at any other stadium if you had seats like that you would be taking pictures level of him.Anyway,just wanted to say great pictures.But of course you already know that.:)
